1. Acceptance of Terms
By creating an account, accessing, or using the Human Interest App, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You have read, understood, and agree to be bound by these Terms
- You agree to our Privacy Policy, which is incorporated into these Terms by reference
If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and Account Registration
2.1 Age Requirement
The App is intended exclusively for users who are 18 years of age or older. By creating an account, you represent and warrant that you are 18 or older. We reserve the right to terminate accounts and remove content if we discover or reasonably suspect a user is under 18.
2.2 Account Creation
To use the App you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activity that occurs under your account
- Notify us immediately at legal@humaninterestapp.com if you suspect unauthorized use of your account
2.3 One Account Per Person
You may maintain only one account. Creating multiple accounts, using someone else's account, or allowing others to use your account is prohibited.
2.4 Identity Verification
We require phone number verification via one-time passcode (OTP) to create an account. You agree to provide a valid phone number and to complete verification as required. We reserve the right to implement additional verification measures at any time.
3. License to Use the App
3.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.
3.2 License Restrictions
You may not:
- Copy, modify, or distribute the App or any portion of it
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any commercial purpose without our written consent
- Remove any proprietary notices or labels on the App
- Use the App in any manner that could interfere with, disrupt, or harm the App or our servers
- Attempt to gain unauthorized access to any portion of the App or its related systems
3.3 Apple and Google Platform Terms
If you download the App through the Apple App Store, your use is also subject to Apple's App Store Terms of Service. If you download through the Google Play Store, your use is also subject to Google's Terms of Service. In the event of a conflict between those terms and these Terms, these Terms govern to the extent permitted.
You acknowledge that Apple and Google have no obligation to provide maintenance or support for the App and are not responsible for any claims relating to the App.
4. Subscriptions and Payments
4.1 Free and Paid Features
The App is free to download. Certain features, including channel subscriptions, require payment. Paid features are clearly identified within the App.
4.2 Channel Subscriptions
Channel subscriptions are offered at $4.99 per channel per month ('Subscription Fee'). By subscribing to a channel, you authorize us to charge the Subscription Fee to your payment method on a recurring monthly basis.
4.3 Billing
All payments are processed through your Apple ID (App Store purchases) or Google Play account (Play Store purchases), in accordance with their respective payment terms. We do not store your full payment card details.
4.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel subscriptions at any time through your App Store or Google Play account settings.
4.5 Price Changes
We reserve the right to change subscription pricing at any time. We will provide reasonable advance notice of any price changes. Your continued use of a subscription after a price change becomes effective constitutes acceptance of the new price.
4.6 Refunds
All purchases are final except as required by applicable law. Refund requests for App Store purchases are handled by Apple in accordance with Apple's refund policy. Refund requests for Google Play purchases are handled by Google. We do not issue refunds directly except where required by law.
4.7 Free Trials
We may offer free trials for certain paid features from time to time. If a free trial is offered, the specific terms will be disclosed at the time of the offer. You must cancel before the end of the trial period to avoid being charged.
5. User Conduct and Community Standards
5.1 Acceptable Use
You agree to use the App in a manner that is lawful, respectful, and consistent with these Terms and our Community Guidelines. You are solely responsible for all content you post, share, or transmit through the App.
5.2 Prohibited Conduct
You agree that you will not use the App to:
- Post, upload, or share content that is unlawful, harassing, defamatory, obscene, fraudulent, or otherwise objectionable
- Harass, threaten, intimidate, stalk, or harm any person
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Post false, misleading, or deceptive content
- Solicit personal information from anyone under 18
- Distribute spam, unsolicited messages, or commercial solicitations
- Upload or transmit viruses, malware, or any code designed to disrupt or harm the App
- Collect or harvest data about other users without their consent
- Use automated tools, bots, or scrapers to access the App
- Engage in any conduct that restricts or inhibits another user's enjoyment of the App
- Post content that infringes any patent, trademark, copyright, or other proprietary rights
- Promote illegal activity or provide instructions for illegal acts
- Post nudity, sexually explicit content, or graphic violence
- Discriminate against or harass users based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
5.3 Reporting Violations
We encourage users to report content or behavior that violates these Terms using the in-app reporting tools or by contacting us at legal@humaninterestapp.com. We will review reports and take appropriate action, which may include removing content, suspending accounts, or contacting law enforcement.
6. User Content
6.1 Ownership
You retain ownership of any content you create and post on the App ('User Content'). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and improving the App.
6.2 Your Representations
By posting User Content, you represent and warrant that:
- You own or have the necessary rights to post the content
- The content does not violate the privacy, publicity, intellectual property, or other rights of any third party
- The content does not violate these Terms or any applicable law
6.3 Content Monitoring
We do not pre-screen User Content but reserve the right to review, remove, or disable access to any User Content at our sole discretion and without notice, including content that we believe violates these Terms or is otherwise harmful.
6.4 Feedback
If you submit feedback, suggestions, or ideas about the App, you grant us the right to use that feedback without restriction or compensation to you.
7. Intellectual Property
The App and all of its content — including but not limited to software, design, graphics, text, logos, and trademarks — are owned by or licensed to Human Interest Group Inc. and are protected by United States and international intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in the App or its content except for the limited license described in Section 3. All rights not expressly granted are reserved.
'Human Interest' and related marks and logos are trademarks of Human Interest Group Inc. You may not use our trademarks without our prior written consent.
8. Privacy
Your use of the App is also governed by our Privacy Policy, available at humaninterestapp.com/privacy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
We take the privacy and safety of our users seriously. We implement industry-standard security measures to protect your personal information. Please review our Privacy Policy for full details on how we collect, use, and protect your data.
9. Third-Party Services and Links
The App may integrate with or contain links to third-party services, websites, or applications. These are provided for your convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party service.
Your interactions with third-party services are governed by those services' own terms and privacy policies. We encourage you to review them.
Our payment processing is handled by Stripe. Your use of payment features is subject to Stripe's terms of service and privacy policy.
10. Disclaimers and Limitation of Liability
10.1 App Provided 'As Is'
THE APP IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10.2 No Guarantee of Connections
We do not guarantee that you will meet any particular person, form any particular connection, or achieve any particular outcome through use of the App. The App provides a platform for community interaction — the quality, safety, and appropriateness of interactions between users is outside our control.
10.3 User Verification Limitations
While we verify phone numbers via OTP, we cannot guarantee the identity, intentions, or conduct of any user. You are responsible for exercising your own judgment in interactions with other users.
10.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUMAN INTEREST GROUP INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
10.5 Jurisdictions That Limit Disclaimers
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Human Interest Group Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising from:
- Your use of or access to the App
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any User Content you post or transmit through the App
- Your interactions with other users
12. Termination
12.1 Termination by You
You may stop using the App and delete your account at any time through the account settings in the App. Deletion of your account does not entitle you to a refund of any prepaid subscription fees.
12.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms or that your continued use poses a risk to other users or to Human Interest.
12.3 Effect of Termination
Upon termination, your license to use the App immediately ceases. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
13.2 Informal Resolution
Before filing any formal legal claim, you agree to contact us at legal@humaninterestapp.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.
13.3 Binding Arbitration
If the dispute is not resolved informally, you and Human Interest Group Inc. agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. By agreeing to arbitration, you waive the right to a trial by jury and to participate in class action lawsuits.
13.4 Class Action Waiver
You agree that any arbitration or legal proceeding will be conducted on an individual basis only and not as a class, consolidated, or representative action. You waive any right to participate in class action litigation.
13.5 Exceptions
Either party may seek emergency injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent imminent harm pending arbitration.
13.6 EU/EEA and UK Users
If you are located in the European Union, European Economic Area, or United Kingdom, you may have the right to bring a claim before the courts of your country of residence. The arbitration clause above does not affect your statutory rights in your jurisdiction.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Human Interest Group Inc. regarding your use of the App and supersede all prior agreements.
14.2 Changes to Terms
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms in the App, updating the Effective Date, and where appropriate, sending notice by email or push notification. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
14.3 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
14.4 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
14.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
14.6 No Third-Party Beneficiaries
These Terms do not confer any third-party beneficiary rights. Apple and Google are third-party beneficiaries of these Terms with the right to enforce them against you as they relate to your license to use the App.
14.7 Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, power failures, or internet outages.
